In the Supreme Court case under the representation of Chief Justice John Marshall, dissenting opinions were fairly rare in the Marshall Court, although Justice William Johnson was responsible for the dissenting opinion of this particular Supreme Court case. Justice William Johnson defended his case by defending the sided of the Native Americans, who were the original rightful owners of the land at hand anyway. He argued that the Georgia legislature had no right in the first place to make any decisions regarding the Yazoo land because it ultimately was not their property to sell. In other words, the "right of soil" belonged to the Indian nations. Johnson pointed out that there were a numerous amount of treaties tracing the land back the the Indian tribes.

Throughout Johnson's life he was well known for his opinions in the courtroom during this particular era in time. In fact, in his lifetime, he was written by his biographer " the first dissenter" and was able to make 112 opinions, concurring and dissenting to the court. Although Johnson reasoning made complete sense he was overruled by the opinions of the other justices on the Marshall Court at this time.
